Terms and Conditions
The owner of the online store Lokitar.ee (hereinafter the Online Store) is Lokitar OÜ (registry code 14610363), with the legal address Liilia tee 6 Viimsi hamlet, Viimsi parish Harju county 74001.
1. VALIDITY OF THE SALE AGREEMENT, COMMODITY AND PRICE INFORMATION
1.1 The Terms of Sale apply to the purchase of goods from the Online Store.
1.2 The prices of the products sold in the online store are indicated next to the products. All prices of goods sold in the online store are in euros. A fee for the delivery of the goods is added to the price.
1.3 The online store reserves the right to adjust prices. If the buyer submitted his order before the price changes took effect, the price that was reflected on the invoice at the time of placing the order applies to him.
1.3 The delivery fee depends on the location of the buyer and the method of delivery. The delivery fee will be shown to the buyer when ordering.
1.4 Information about the goods is provided in the Online Store directly next to the goods.
2. PLACING AN ORDER
2.1 To order the goods, you must add the desired products to the shopping cart. To place an order, you must select the appropriate method of product delivery and fill in the required data fields. The amount of the fee will then be displayed on the screen, which can be paid securely through the following payment methods:
- Estonian banking links: Swedbank, SEB, Luminor, LHV, Coop Pank;
- By the bill. In this case, the order invoice will be sent to the buyer’s e-mail.
NB! When paying with a bank link, be sure to click the “Back to Merchant” button on the bank’s page.
2.2 Payments are mediated by Maksekeskus AS . Payment takes place outside the Online Store in a secure environment – when paying with a bank link in the secure environment of the respective bank. The seller does not have access to the customer’s bank and credit card details. The agreement enters into force upon receipt of the amount due to the current account of the Online Store.
2.3 The owner of the online store is the chief processor of personal data and forwards the personal data necessary for making payments to the authorized processor Maksekeskus AS.
2.4 The Agreement enters into force upon receipt of the amount due to the current account of the Online Store.
2.5 If the ordered goods cannot be delivered due to the expiration of the goods or for any other reason, the buyer shall be notified as soon as possible and the money paid (incl. Delivery costs) shall be refunded immediately, but not later than within 14 days of sending the notice.
3.1 Goods are sent within Estonia.
3.2 The costs of shipping the goods shall be borne by the buyer and the corresponding price information shall be displayed next to the method of delivery. For orders over 45 €, transport within Estonia is free.
3.3 Orders will be posted within 1-3 working days.
3.4 Shipments within Estonia will generally reach the destination specified by the buyer within 1-5 working days from the entry into force of the sales contract. In exceptional cases, the goods have the right to be delivered within 7 calendar days.
3.5 Lokitar.ee products cannot be ordered abroad via the online store. If you want to order products abroad, write your request to firstname.lastname@example.org.
4. RIGHT OF WITHDRAWAL
4.1. After receiving the order, the buyer has the right to withdraw from the contract concluded in the e-shop within 14 days.
4.2. The right of withdrawal does not apply if the buyer is a legal entity.
4.3 In order to exercise the 14-day right of return, the ordered goods may not be used in any other way than is necessary to verify the nature, characteristics and functioning of the goods in the manner permitted for inspection.
4.4 The right of withdrawal may not be exercised if the consumer has already used the product, tried it with his finger or opened the packaging in such a way that it can no longer be offered to third parties for health or hygiene reasons.
4.5 In order to return the goods, the wish to withdraw must be notified by e-mail email@example.com no later than within 14 days of receipt of the goods.
4.6 The costs of returning the goods shall be borne by the buyer, unless the reason for the return is that the item to be returned does not correspond to the ordered item (eg a wrong or defective item)
4.7 The buyer must return the goods within 14 days of submitting the application or provide proof that he has handed over the goods to the carrier within the aforementioned period.
4.8 Upon receipt of the returned goods, the online store shall return to the buyer immediately, but not later than 14 days after receipt of the withdrawal application, all fees received from the buyer on the basis of the contract.
4.9 The online store may refuse to make refunds until the item that is the subject of the contract has been returned or until the buyer has provided proof that he has returned the item, whichever is earlier.
4.10 If the Buyer has explicitly chosen a delivery method different from the cheapest usual delivery method offered by the Online Store, the Online Store does not have to reimburse the consumer for the cost that exceeds the cost related to the usual delivery method.
4.11 The online store has the right to withdraw from the sale transaction and reclaim the goods from the buyer if the price of the goods in the online store is significantly lower than the market price of the goods due to a mistake.
5. RIGHT TO SUBMIT A COMPLAINT
5.1 The online store is liable for non-compliance or defect of the goods sold to the buyer, which already existed at the time of delivery of the thing and which becomes apparent within two years from the delivery of the goods to the buyer. During the first six months from the delivery of the thing to the buyer, it is assumed that the defect already existed at the time of delivery. It is the responsibility of the Online Store to rebut the respective presumption.
5.2 In the event of a defect, the Buyer has the right to contact the online store within two months at the latest by sending an e-mail to firstname.lastname@example.org .
5.3 The online store is not responsible for defects that have occurred after the delivery of the goods to the buyer.
5.4 If the goods purchased from the Online Store have defects for which the Online Store is responsible, the Online Store will repair or replace the defective goods. If the goods cannot be repaired or replaced, the Online Store will return all fees associated with the sales contract to the buyer.
5.5 The online store shall respond to the consumer’s complaint in writing or in a form that can be reproduced in writing within 15 days.
6. PROCESSING OF PERSONAL DATA
6.1 The online store uses the personal data provided by the buyer and data on the purchases made in accordance with the Personal Data Protection Act to the extent necessary to fulfill the order submitted by the buyer in the e-shop. The online store does not transfer the buyer’s personal data to third parties, except for the company providing postal or courier services to the extent necessary for the delivery of the goods to the buyer.
6.2. The buyer has the right to prohibit the collection and use of his personal data at any time, unless this is necessary for the collection of a claim arising from the contract or for the delivery of the goods.
6.3. The use of electronic personal data for direct mail only takes place if the buyer has given a separate consent on the lokitari.ee website.
6.4. The online store does not have access to the customer’s banking data when paying for the goods via the Internet bank.
7. SETTLEMENT OF DISPUTES
7.1 If the buyer has any complaints regarding the Online Store, they must be sent to the e-mail address email@example.com .
7.2 If the Buyer and the Online Store are unable to resolve the dispute by agreement, the Buyer may turn to the Consumer Disputes Committee. The procedural conditions are available and the application can be submitted on the website of the Consumer Protection Board. The Consumer Disputes Committee is competent to resolve disputes arising from the contract concluded between the buyer and the Online Store. The review of the buyer’s complaint in the commission is free of charge.
8.1 The design, images, photos and texts of the online store are protected by copyright and the right to use them belongs to Lokitar OÜ. The content of the website may not be reproduced, distributed or modified without the written permission of Lokitar OÜ, including blog posts and other materials.
